Terms and conditions of on-line booking

WHAT SHOULD I KNOW BEFORE I BOOK?

The customer acknowledges, prior to booking, being fully aware of all the information mentioned below and the terms of the present general conditions. They also confirm having the legal capacity to conclude this contract.

SUBJECT:
This contract is a distance contract which aims to define the rights and obligations of the parties in the context of travel bookings (excursions, tours, transport and other services) proposed online by Marrakech Budget Tours, a travel agency based in Marrakech, Morocco, in collaboration with a secured payment system to protect payment methods and client information.

DEFINITIONS:
« Distance contract » : defines the firm booking and the remote deposit payment by the client in favour of Marrakech Budget Tours, which exclusively uses the internet network and secure online payment measures, as governed by the legal provisions currently applied in Morocco.
« Client » : any natural person acting for purposes outside their professional activity.
« Order form » : a document indicating the characteristics of the services reserved by the client, validated by confirmation click, involving a deposit payment.
« Order / Reservation » : the act by which the client commits to purchasing the service and Marrakech Budget Tours commits to providing it.
« Product » : any service or experience proposed by Marrakech Budget Tours.
« Confirmation click » : the client's reiteration of the order form's validity by clicking « Confirm your booking ».

ORDER PERFORMANCE

The booked service will be provided on the date and time confirmed in the booking on the website of Marrakech Budget Tours.

GENERAL CONDITIONS FOR BOOKING VIA OUR WEBSITE

PRICES
All prices listed on the Marrakech Budget Tours website are indicated in Euros, inclusive of all applicable taxes. The invoiced prices are those in effect at the time of booking, taking into account the applicable VAT. The total amount to be paid will automatically include any applicable official taxes and bank fees.

PAYMENT METHOD
The client guarantees that they are authorised to use their chosen payment method at the time of order validation. Payment information is transmitted via secured and encrypted means. In case of fraudulent use of a payment card, the applicable conventions between the consumer and the card issuer shall apply.

DEPOSIT & BALANCE PAYMENT
The client pays a deposit of 20% of the total amount (non-refundable) via the secured payment system on the website of Marrakech Budget Tours. The electronic receipt displayed after booking validation constitutes proof of payment until the transaction is finalised. The remaining balance is payable on the spot to the Marrakech Budget Tours representative.

MODIFICATION, CANCELLATION & NO-SHOW
In case of modification or cancellation by the client, or in case of no-show, the following penalties apply:
— From 30 to 15 days before the activity date: 20% of the total amount
— From 15 to 7 days before the activity date: 50% of the total amount
— Less than 7 days before the activity date: 100% of the total amount

BOOKING MODIFICATION BY MARRAKECH BUDGET TOURS
If a modification to the confirmed booking is required on our part, Marrakech Budget Tours commits to offering an equivalent or superior alternative at no additional cost to the client.

PERSONAL DATA
Information collected during the booking process is used solely to process the client's order and is transmitted securely. The client has the right to access and rectify their personal data at any time by contacting us directly.

ELECTRONIC SIGNATURE
The confirmation click associated with the booking and payment process constitutes an electronic signature, which has the same legal value as a handwritten signature. It implies the client's full agreement with these general conditions.

STORAGE OF TRANSACTIONS
Booking orders, receipts and invoices are stored on a reliable and secure medium, in compliance with standard norms for data system management, ensuring the preservation and integrity of all recorded information.

DISPUTE SETTLEMENT
In the event of a dispute, both parties commit to seeking an amicable resolution before any legal action. This contract is subject to Moroccan law. Any unresolved dispute shall be brought before the competent court of Marrakech.

FORCE MAJEURE
Marrakech Budget Tours shall not be held liable for failure to perform its obligations in the event of a force majeure situation constituting an insurmountable obstacle to the fulfilment of said obligations.
